NEW UK IMMIGRATION SCHEME: HOME OFFICE INTRODUCES NEW PATHWAY TO IMMIGRATION AND PERMANENT RESIDENCY FOR THOSE WITH PROVEN OR PROMISING TALENT



The UK Home Office is introducing a Tier 1 Exceptional Talent Route; a points-based system for immigration by individuals with skills in science, technology, engineering and mathematics from outside the European Economic Area (EEA). 
To be a recipient of the scheme, you have to undergo a two-stage process: apply to the Home Office for endorsement as an exceptional leader or an emerging leader in your field, and if successful, then apply for the visa. 


According to Home Office, "This route is designed for highly skilled individuals in the fields of science, humanities, engineering, the arts and digital technology who will enrich the UK’s knowledge economy and cultural life. We recognise that such talented individuals should have few restrictions on their economic activity once here. If you qualify, the route allows you to work and change employers, or to be self-employed, without the need for further authorisation or to be sponsored for employment in a specific post."

Benefits of the Tier 1 (Exceptional Talent) Visa
The benefits are that upon arrival in the UK,
1.   You can work as self-employed/contracted/employed;
2.   You can work in any sector
3.   You can work for any employer and move between employers without any additional approval from the Home Office
4.   You can take up employment at any level
5.   Most UK immigration categories have a 5-year residency requirement to live in the UK legally before migrants can obtain indefinite leave to remain. At the end of three years, those on this scheme would be able to apply for indefinite leave to remain; giving them a permanent right to reside in the UK, and access to the same benefits and healthcare as British citizens.
6.   Applicants under this scheme do not need to secure a job before applying, getting their applications approved, or entering the UK. They only need to demonstrate that they meet certain mandatory criteria for the scheme.
7.   Unlike other immigration categories, individuals who successfully migrate to the UK on this scheme will be able to include and bring their adult dependants, including other dependants (spouse and children), and they will have full access to the labour market.
8.   Applicants who are outside the UK and those currently in the UK are eligible to apply for this scheme.
9.   There is NO minimum English language requirement for application under this scheme. 

Who cannot work in the UK under this scheme? 
1.   Doctor or Dentist in Training
2.   Professional sportsperson or coach

The Application Process
Applying for this scheme for the first time is a two-stage process:
Stage 1 assesses your skills, abilities and achievements, and enables the Designated
Competent Bodies to decide whether you should be endorsed in order to progress your application. Note that having a PhD is a mandatory requirement for this stage. Stage 1 application is submitted online, and can be done from wherever you are in the world. However, supporting documents have to be sent to the UK for consideration.
If you are granted an endorsement by a Designated Competent Body, you must then apply for Tier 1 (Exceptional Talent) visa to enter or remain in the UK.

Stage 2 requires you to submit your application for Tier 1 (Exceptional Talent) visa if your stage 1 was successful. This stage is undertaken solely by the Home Office and assesses immigration matters only.
Please note that there are separate fees for each stage. And also, there are only 2,000 places available under this visa category between 6 April of any year to 5 April of the following year.

This new measure is likely the result of a need to increase skilled migration to the UK, especially in order to fill strategic jobs in the wake of Brexit uncertainties. For more detailed information about the application process, please see here
